These Terms of Service ("Terms") govern your use of the websites, AI assistants, phone services, and related products provided by Byrd Ai ("Byrd Ai," "we," "us," or "our"). By purchasing or using our services, you agree to these Terms.
Byrd Ai builds and maintains websites and AI assistant tools for businesses, which may include a custom website, a 24/7 AI chat assistant, an AI phone receptionist, hosting, and ongoing support. The specific services you receive depend on the package you select.
We may build a custom demo of your website and AI assistant before payment. You are under no obligation to purchase. Work to launch your live service begins after you approve and your order is placed.
There are no long-term contracts — you may cancel your monthly subscription at any time through the customer portal or by contacting us, and it will remain active until the end of your current billing period. Setup fees and work already performed are non-refundable. Monthly subscription fees already paid for the current period are non-refundable, but you will not be charged for future periods after cancellation.
Our AI chat and phone assistants generate responses automatically and are designed to follow the information you provide. AI can occasionally produce inaccurate or unexpected responses. You are responsible for reviewing the information your assistant uses, and Byrd Ai is not liable for outcomes resulting from AI-generated responses. AI assistants are a convenience tool and do not replace professional, legal, medical, or financial advice.
You own the business content you provide and the final website content we deliver for your business. Byrd Ai retains all rights to its underlying platform, software, templates, AI integrations, and tools. You may not copy, resell, or reverse-engineer our platform.
Our services rely on third-party providers (including Stripe, OpenAI, and Twilio). Your use of features powered by these providers may also be subject to their terms. We are not responsible for outages or changes outside our control.
We work to keep services available and reliable but do not guarantee uninterrupted or error-free operation. We may perform maintenance or updates as needed.
To the maximum extent permitted by law, Byrd Ai is not liable for any indirect, incidental, or consequential damages, or for lost profits or revenue. Our total liability for any claim is limited to the amount you paid us for the services in the three (3) months before the claim.
You agree to indemnify and hold Byrd Ai harmless from claims arising out of content you provide, your use of the services, or your violation of these Terms.
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules.
We may update these Terms from time to time. Changes take effect when posted on this page. Your continued use of the services after changes means you accept the updated Terms.
